By visiting our site and/or purchasing from us, you engage in our “Service” and agree to be bound by the following Terms of Service (“Terms”), including any additional terms, conditions, and policies referenced herein and/or available by hyperlink. These Terms apply to all users of the site, including browsers, customers, merchants, vendors, and contributors of content.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services.

These Terms of Service incorporate by reference our Shipping Policy and Refund Policy, which are available on our website. By placing an order, you acknowledge that you have reviewed and agree to all policies in effect at the time of purchase.

SECTION 1 – ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor violate any laws in your jurisdiction.

Any breach or violation of these Terms may result in immediate termination of services.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time.
You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.

Credit card information is always encrypted during transfer over networks.

SECTION 3 – ACCURACY, COMPLETENESS & TIMELINESS OF INFORMATION

We are not responsible if information on this site is not accurate, complete, or current. Any reliance on site material is at your own risk. We reserve the right to modify site content at any time without obligation to update.

SECTION 4 – MODIFICATIONS TO SERVICE & PRICES

Prices are subject to change without notice.
We may modify or discontinue the Service at any time without liability.

SECTION 5 – PRODUCTS & AVAILABILITY

Certain products may be available exclusively online and in limited quantities.
All product descriptions, pricing, and availability are subject to change at our sole discretion.

We do not guarantee that product colors or appearance displayed on your device will be exact.

SECTION 6 – ORDER FINALITY, PROCESSING & SHIPPING

  • All sales are final unless otherwise expressly stated in writing or required by applicable law.

  • Most in-stock items are processed within 2–3 business days, unless otherwise stated in the product description.

  • Processing time does not include shipping transit time.

  • Multiple shipping speeds are offered at checkout.

  • Shipping speed upgrades may only be requested within 2 hours of purchase.

  • Orders cannot be canceled once placed.

Once an order has shipped, delivery timelines are the responsibility of the carrier.

SECTION 7 – ORDER MODIFICATIONS & ADDRESS POLICY

  • Customers have up to 2 hours after purchase to request:

    • A size change (subject to availability), or

    • A shipping speed upgrade only.

  • Shipping downgrades are not permitted.

  • Shipping addresses cannot be changed once an order is placed.

  • Minor corrections (such as fixing a letter or number) may be permitted at our discretion.

  • Completely changing the shipping address is not permitted.

Rose Collections, LLC is not responsible for orders delivered to an incorrectly provided address.

SECTION 8 – DELIVERY CONFIRMATION & RESPONSIBILITY

  • Once a package is marked “Delivered” by the carrier, the order is considered fulfilled.

  • We are not responsible for lost, stolen, or misdelivered packages after delivery confirmation.

  • Carrier delays, weather issues, customs delays, or third-party errors are beyond our control.

  • Customers may be required to cooperate with carrier investigations in cases of delivery disputes.

SECTION 9 – DAMAGE, MISSING ITEM & DELIVERY ISSUE REPORTING

  • Any issues involving missing items, incorrect items, damage, or delivery problems must be reported to sales@shaniarose.com within 72 hours of delivery confirmation.

  • Claims submitted after 72 hours may be denied at our sole discretion.

  • Photo documentation and packaging images may be required to review claims.

SECTION 10 – BILLING ACCURACY & ACCOUNT INFORMATION

We reserve the right to refuse or cancel orders that appear fraudulent, abusive, or in violation of these Terms.
You agree to provide accurate billing and account information for all purchases.

SECTION 11 – CHARGEBACKS, PAYMENT DISPUTES & FRAUD PREVENTION

By placing an order with Rose Collections, LLC, you agree to the following:

  • Customers must contact us first at sales@shaniarose.com to attempt resolution before initiating any chargeback or payment dispute.

  • Chargebacks filed for orders that were:

    • Successfully delivered,

    • Processed in accordance with our stated policies, and/or

    • Not reported within the required timeframe
      may be considered invalid or fraudulent.

  • We reserve the right to submit all relevant documentation to payment processors, financial institutions, and dispute resolution services, including but not limited to delivery confirmation, tracking data, IP address, device information, order history, and customer communications.

  • If a chargeback or dispute is determined to be fraudulent, Rose Collections, LLC reserves the right to pursue all lawful remedies, including reporting the activity to payment providers and fraud monitoring services, referring the outstanding balance to third-party collection agencies, and/or initiating legal action to recover disputed funds, chargeback fees, administrative costs, and any other damages permitted by law.

  • Customers who abuse the dispute or chargeback process may be permanently restricted from future purchases.

SECTION 12 – THIRD-PARTY LINKS & PAYMENT PROVIDERS

We are not responsible for third-party websites, tools, or services linked on our site. Third-party payment providers (such as Klarna) may offer installment or pay-later options subject to their own terms and approval. Rose Collections, LLC is not responsible for decisions made by third-party payment providers.

SECTION 13 – USER COMMENTS & SUBMISSIONS

Any feedback, suggestions, or submissions may be used by us without restriction. You are responsible for the legality and content of any submissions.

SECTION 14 – PROHIBITED USES

You are prohibited from using the site or its content for unlawful, abusive, fraudulent, or harmful purposes. Violations may result in termination of access.

SECTION 15 – DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

These Terms shall be governed by and construed in accordance with the laws of the state in which Rose Collections, LLC is registered, without regard to conflict-of-law principles. Any disputes shall be resolved in the appropriate courts located within that jurisdiction.

SECTION 21 – CHANGES TO TERMS

We reserve the right to update these Terms at any time. Continued use of the site constitutes acceptance of the Terms in effect at the time of use or purchase.
